These Terms of Service ("Terms") govern your access to and use of NetAtlas, including our websites, APIs, services, and related content (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility and Account Registration

1.1. You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the consent of a parent or legal guardian.

1.2. Certain features may require an account. You agree to provide accurate information and to keep it up to date.

1.3. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

2. Service Description

2.1. NetAtlas provides automated indexing and historical visibility into publicly reachable online resources and network-related metadata, including domains, IP addresses, and URLs.

2.2. The Service may include archived snapshots, timelines, indicators, and related analytical features.

2.3. We may modify, suspend, or discontinue any portion of the Service at any time.

3. Acceptable Use

You agree not to, and not to enable others to:

3.1. Use the Service for unlawful purposes or in violation of any applicable law or regulation.

3.2. Attempt to gain unauthorized access to systems, accounts, data, or networks.

3.3. Use the Service to facilitate malware distribution, phishing, fraud, harassment, doxxing, stalking, or other harmful activity.

3.4. Scrape, harvest, or exfiltrate the Service at scale, including via bots or automated means, except as expressly permitted by the Service or by written authorization (including documented API usage limits).

3.5. Reverse engineer or attempt to discover source code, trade secrets, or underlying datasets not intended for public access.

3.6. Interfere with or disrupt the Service, including bypassing rate limits or security controls.

4. API and Rate Limits

4.1. If you use our API, you must comply with our documentation, rate limits, and usage policies.

4.2. We may enforce throttling, suspend API keys, or revoke access if we detect abuse, excessive usage, or violations of these Terms.

5. Content, Snapshots, and Accuracy

5.1. The Service may display data and snapshots collected from third-party sources and public endpoints. We do not create or control the original third-party content.

5.2. No guarantee of completeness or accuracy: The internet changes constantly, and archived results may be partial, missing, or reflect errors, transient outages, geoblocking, paywalls, or other access constraints.

5.3. Snapshots represent what our systems observed at a specific time. They are not endorsements, and they may not reflect current reality.

6. Intellectual Property

6.1. The Service, including our software, designs, trademarks, and proprietary datasets (excluding third-party content), is owned by NetAtlas and/or its licensors and is protected by intellectual property laws.

6.2. Third-party content may remain subject to the rights of its respective owners.

6.3. You may not copy, reproduce, distribute, or create derivative works of the Service's proprietary materials except as permitted by these Terms or by written authorization.

7. User Submissions and Feedback

7.1. If you submit feedback, suggestions, or ideas, you grant us a non-exclusive, worldwide, royalty-free license to use them for any purpose without obligation or compensation.

8. DMCA / Copyright and Removal Requests

8.1. If you believe content on the Service infringes your copyright, you may submit a notice consistent with the Digital Millennium Copyright Act ("DMCA") or applicable law.

8.2. We may remove or restrict access to content at our discretion, including in response to valid legal requests.

8.3. We may also accept removal requests for certain sensitive content where appropriate, even if not legally required.

9. Privacy

9.1. Our collection and use of information is described in our Privacy Policy (if posted).

9.2. The Service may process technical data necessary to operate, secure, and improve the Service (e.g., IP addresses for abuse prevention, logs, analytics, fraud detection).

10. Suspension and Termination

10.1. We may suspend or terminate your access at any time if we reasonably believe you violated these Terms, abused the Service, or created risk for other users or the platform.

10.2. Upon termination, your right to use the Service ceases immediately.

11. Disclaimers

11.1. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

11.2. NETATLAS DOES NOT PROVIDE LEGAL, INVESTIGATIVE, OR PROFESSIONAL ADVICE. YOU ARE RESPONSIBLE FOR HOW YOU USE THE INFORMATION.

12. Limitation of Liability

12.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, NETATLAS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

12.2. IN NO EVENT WILL NETATLAS'S TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO NETATLAS IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) $100 USD.

13. Indemnification

You agree to indemnify and hold harmless NetAtlas and its affiliates from any claims, damages, liabilities, and expenses (including attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another.

14. Governing Law and Dispute Resolution

14.1. These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.

14.2. Any dispute arising from these Terms or the Service will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Effective Date." Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
